Terms of Service

1. Agreement to Terms

By downloading, installing, or using Obvia ("the App"), provided by Ephesian 28 LLC ("Company", "we", "us"), you agree to be strictly bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must immediately uninstall and discontinue use of the App.

THESE TERMS INCLUDE A BINDING ARBITRATION CLAUSE AND A CLASS ACTION WAIVER.

2. Description of Service

Obvia is a wellness application that provides:

  • Daily affirmations and inspirational quotes
  • Guided affirmation sessions with optional voice playback
  • AI-generated personalized affirmations based on guided prompts

The App is designed solely for informational, educational, and entertainment purposes.

3. Health and Medical Disclaimer

THE APP IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE.

(a) No Medical Advice: The content, tools, and AI-generated affirmations within the App are not intended to diagnose, treat, cure, or prevent any disease, mental health condition, or physical ailment.

(b) Consult a Professional: Always seek the advice of your physician or qualified health provider. Never disregard professional medical advice because of something you read in the App.

(c) Use at Your Own Risk: Your use of any information or tools provided by the App is solely at your own risk.

(d) Emergency: If you think you may have a medical emergency, call your doctor or 911 immediately.

4. User Conduct & Prohibited Use

You agree to use the App only for lawful purposes. You are strictly prohibited from:

  • Using the App for any illegal purpose
  • Harassing, threatening, or defrauding other users or the Company
  • Meaningfully attempting to bypass any security features
  • Reverse engineering, decompiling, or disassembling the App
  • Using the AI affirmation feature to generate hate speech, violence, or illegal content

Ephesian 28 LLC reserves the right to terminate your access immediately, without notice, for any violation of these Terms.

5. Intellectual Property Rights

The App and its entire contents, features, and functionality are owned by Ephesian 28 LLC and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

6. AI-Generated Content Disclaimer

  • AI-generated affirmations may be inaccurate, inappropriate, or misleading
  • Do not rely on AI-generated content for advice of any kind, including medical, legal, or financial advice
  • Ephesian 28 LLC disclaims all liability for actions taken based on AI-generated content

7. Subscriptions and Auto-Renewal

Obvia offers optional auto-renewable premium subscriptions ("Obvia Pro") that unlock additional features. Payment is charged to your Apple ID account at confirmation of purchase.

Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate shown in the app at the time of purchase.

You can manage or cancel subscriptions at any time in your Apple ID Account Settings. Any free trial or introductory offer, if available, converts to a paid subscription unless canceled before the trial ends.

Ephesian 28 LLC does not process subscription payments directly. All billing, refunds, and subscription management are handled by Apple in accordance with Apple's Media Services Terms and Conditions.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

(A) IN NO EVENT SHALL EPHESIAN 28 LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR APP, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION STORED THEREIN.

(B) IN NO EVENT SHALL THE TOTAL LIABILITY OF EPHESIAN 28 LLC EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE APP.

9. Indemnification

You agree to defend, indemnify, and hold harmless Ephesian 28 LLC and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses, including but not limited to attorney's fees, arising from: (i) your use of and access to the App; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right. This defense and indemnification obligation will survive these Terms and your use of the App.

10. Dispute Resolution: Arbitration & Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

(a) Binding Arbitration: Any dispute, controversy, or claim arising out of or relating to these Terms or the App shall be settled by binding arbitration in accordance with the American Arbitration Association (AAA) rules. Judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

(b) Class Action Waiver: YOU AND EPHESIAN 28 LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

(c) Jury Trial Waiver: You and Ephesian 28 LLC hereby waive any constitutional and statutory rights to sue in court and have a trial in front of a judge or a jury.
